Settlement Negotiation & Implementation

We have been involved in many of the major mass tort losses over the past thirty years and our work has included the following:

  • Led the implementation of a nation-wide $600 million class action settlement involving patients who contracted HIV from their use of blood products;
     
  • Designed predictive models to estimate the scope, extent and "present value" of personal injury claims involving contingent complications which formed the basis of a court-approved class settlement;
     
  • Created coverage-in-place and claims handling agreements with domestic and international insurance carriers, both solvent and insolvent, which facilitated the prompt and cost-effective reimbursement of millions of losses incurred in mass tort losses involving HIV, Hepatitis C and other injuries;
     
  • Designed, negotiated and drafted nationwide settlement agreements in a class action concerning patients who were exposed to possible infection with Hepatitis C through their use of an intravenous gamma globulin blood product and directed the implementation of such agreements to ensure payment to both class and opt-out claimants;
     
  • Developed and structured a cost-sharing agreement that permitted our client, who was self-insured, to access insurance proceeds under a material supplier's primary and excess policies, when faced with hundreds of lawsuits nationwide involving alleged product contamination;
     
  • Implemented the global settlement of claims from more 25 countries by thousands of individuals suffering from hemophilia who allegedly contracted HIV or Hepatitis C as a result of their use of blood therapies.
