Successfully defended and resolved on favorable terms a putative consumer class action alleging violations of California’s Consumer Legal Remedies Act ("CLRA"), Cal. Code Civ. P. §§ 1750, et seq., and Unfair Competition Law ("UCL"), Cal. Bus. & Prof. Code § § 17200 et seq., among others claims, against a pharmaceutical manufacturer.
Settlement Negotiation & Implementation:

Designed, negotiated and then implemented nationwide settlement agreements in a class action involving more than 6,000 individuals with hemophilia who were allegedly infected with HIV through the use of plasma derivatives designed to control their hemophilia.

Developed predictive models to estimate the scope, extent and "present value" of personal injury claims involving payments for potential future medical complications included in a court-approved class settlement.

Created coverage-in-place and claims handling agreements with domestic and international insurance carriers, both solvent and insolvent, which have facilitated the prompt and cost-effective reimbursement of hundreds of millions of dollars of losses incurred in several mass tort losses involving HIV, Hepatitis C and other injuries.

Developed and structured a cost-sharing agreement that permitted our client to access insurance proceeds under a material supplier’s primary and excess policies, where client itself was self-insured for hundreds of lawsuits nationwide involving alleged product contamination.
