Shapiro, Rodarte & Forman LLP has achieved exceptional results for its clients, not only in court but also through alternative dispute resolution mechanisms such as mediation, arbitration and traditional, face-to-face negotiations.
- SR&F was one of the principal architects in designing, negotiating, and drafting nationwide settlement agreements in two large-scale, class actions. The first involved hemophilia-afflicted individuals who were allegedly infected with HIV through the use of plasma derivatives designed to control their hemophilia. The settlement class involved 25,000 claimants and more than 6,200 HIV infected individuals. The second class action settlement concerned patients who were exposed to possible infection with Hepatitis C through their use of an intravenous gamma globulin blood product.
- SR&F has created coverage-in-place and claims handling agreements with domestic and international insurance carriers, both solvent and insolvent, which have facilitated the prompt and cost-effective reimbursement of hundreds of millions of dollars of losses incurred in the HIV, Hepatitis C and other mass tort losses.
- In connection with structuring personal injury settlements involving contingent complications, SR&F helped to create predictive models to estimate the scope, extent and "present value" of such claims.
- SR&F identified more than $10 million of insurance coverage for a medical supply corporation in connection with a newly-evolving loss, where the corporation had originally concluded that such coverage did not exist.
- SR&F successfully defended a well-established New York law firm in a transactional malpractice action involving a complex international financing dispute.
-
On behalf of a major motorcycle distributor, SR&F successfully prosecuted a multi-million dollar claim against the California Insurance Guarantee Association, which had denied any responsibility to step into the shoes of the client's defunct primary insurer.
- Without resorting to litigation, SR&F was able to obtain full payment for a Fortune 500 client from an equipment purchaser, after a third party finance company defaulted on its payment obligations.
- On behalf of a luxury hotel, SR&F was able to facilitate a favorable settlement of a serious personal injury claim by achieving (without litigation) the resolution of multiple primary and excess coverage issues that threatened to block the settlement.
